1. Introduction

I@D Deutschland GmbH (hereinafter “I@D” or “we”) is the controller within the meaning of the General Data Protection Regulation (“GDPR”). Unless otherwise stated, I@D is responsible for the processing of personal data collected through the use of the website – www.iaddeutschland.de. I@D respects your privacy by processing and protecting the personal data you provide to us in accordance with applicable data protection laws. In this privacy statement, we explain what personal data I@D collects, uses and for what purpose. We recommend that you read it carefully.

3. Modalities of data collection and processing

3.1 Visiting the website

When you visit and navigate the website, information is automatically sent to our website server by the browser you are using. This information is temporarily stored in a so-called log file. The following information is collected and stored until automated deletion:

  • IP address
  • Date and time of the request
  • Time zone difference to Greenwich Mean Time (GMT)
  • Content of the request (specific page)
  • Access status/HTTP status code
  • Amount of data transferred in each case
  • Website from which the request comes
  • Browser
  • Operating systems and its interface
  • Language and version of the browser software
  • Information about the user’s navigation and interactions with the services and/or the website (search history, forms, cookies, etc.),
  • Geolocation information only if he/she so chooses.

Users’ IP addresses are collected in the servers’ Nginx logs and kept for 15 days. These data are used for traffic analysis. They are deleted after the termination of use.

We process the aforementioned data to ensure smooth connection establishment and user-friendly use of the website, to ensure network and information security, to evaluate system security and stability, and for administrative purposes. The legal basis for data processing is Art. 6 para. 1 p. 1 lit.f DSGVO. The legitimate interest follows from the aforementioned purpose for collecting data. We do not use this data to draw conclusions about your person.

3.2 Contact form

If you fill out a contact form used on our website, we collect the following data

  • First and last name
  • Your address
  • E-mail address
  • Telephone number
  • Area of your property
  • Price of your property
  • Number of rooms, bedrooms

The collection of this data is based on your consent in accordance with Art. 6 para.1 p.1 lit. a DSGVO. You can revoke your consent at any time with effect for the future and unsubscribe from the newsletter. To do so, use either the link at the end of the newsletter or, alternatively, the above-mentioned e-mail address. The revocation will result in I@D no longer continuing the data processing based on this consent for the future and deleting the data, unless there is another legal basis or there are statutory retention obligations.

3.3.The User Data processed by the Company is used for the following purposes:

  • Creating an account
  • Create, receive and manage notifications about properties on the Website.
  • To reply to the User by e-mail, to send various information or advertisements that the Company has published on the Website.
  • To provide general statistics about the traffic on its website and/or application and the various sections contained therein,
  • To send e-mail newsletters to the user about the development of the website and the various sections of the website.
  • Information requests from individuals to representatives of the iad network, the network itself.

The user data processed by the company will also be used for marketing purposes, to respond to requests for information and advertising addressed by users to third party partners, provided that users expressly consent to this.

4. Recipients of the data

Within I@D, those departments will receive access to your data that need it to process the above-mentioned purposes. Contract processors and other service providers used by us may also receive data for these purposes. These are companies in the categories of marketing, IT and customer satisfaction surveys. Data will only be passed on to recipients outside I@D international, including I@D, if regulations permit or require this, you have given your consent or I@D is otherwise authorized to pass on data. Under these conditions, recipients of personal data may be:

  • To the IT service providers used by I@D;
  • Public authorities, in the event of a legal or official obligation.

In rare individual cases of maintenance or fault analysis, support partners of hardware or software may be used. The legally stipulated contractual regulations on purpose limitation and confidentiality as well as – if necessary – confidentiality obligations are concluded with these. Other data recipients may be those entities for which you have given us your consent to transfer data.

If we process personal data in a third country (i.e. outside the European Union (EU) or the European Economic Area (EEA)) or if this is done in the context of using third-party services or disclosing, or transferring data to third parties, this will only be done if it is done to fulfill our (pre)contractual obligations, on the basis of your consent, due to a legal obligation or on the basis of our legitimate interests. If there are no legal permissions, we only allow data to be processed in a third country if the special requirements of Art. 44 ff. DSGVO are met.

The data transferred by I@D International to service providers can only be used by them to fulfill your order. The service providers are carefully selected by I@D and commissioned in writing. They are subject to the instructions of I@D and are controlled by it.

5. duration of storage

For the processing operations carried out by us, we indicate below in each case how long your data will be stored by I@D and when it will be deleted or blocked. Unless an explicit storage period is specified below, your personal data will be deleted or blocked as soon as the purpose or legal basis for storing it no longer applies.

However, storage may take place beyond the specified time in the event of a (threatened) legal dispute with you or other legal proceedings, or if storage is provided for by legal regulations to which we are subject as the responsible party. If the storage period prescribed by legal regulations expires, the personal data will be blocked or deleted, unless further storage by us is necessary and there is a legal basis for this.

6. Visiting our social media pages

6.1 When you visit the profiles of I@D, your personal data will be collected, used and stored not only by I@D but also by the operators of the respective social network. This also happens if you yourself do not have a profile in the respective social network. The individual data processing operations and their scope differ depending on the operation of the respective social network and are not necessarily traceable. For details about the collection and storage of your personal data as well as the type, scope and purpose of their use by the operator of the respective social network, please refer to the privacy statements of the respective operator.

7. Newsletter and notifications

The Company may send the User commercial information by e-mail, which will enable the User to become better acquainted with the services published and operated by the Company.

Unless the User refuses, the Company reserves the right to evaluate his/her personal data and provide them to third parties, in particular to market research companies or survey institutes, exclusively for study and analysis purposes or to third companies in the context of joint or non-joint commercial offers sent by e-mail.

If the User no longer wishes to receive offers and information from the Company, he/she may opt out of receiving them by indicating this at any time in his/her account in the “Subscriptions” section and clicking on the unsubscribe hyperlink located at the bottom of each electronic communication received.

The User may personalize the sending of newsletters and manage the subscriptions for the notifications he/she wishes to receive when creating his/her account or in his/her account under the “Subscriptions” heading. The User will then have the possibility to select among the different categories of newsletters those that interest him. The user can stop receiving newsletters and notifications at any time by going to their account.

If the User does not make a selection and has not objected when creating his/her account, he/she may receive information about news from the Company, as well as newsletters and notifications related to products and services similar to those that the User has already viewed on the Website and/or in the Application.

8. Your rights

According to the applicable legal provisions, you are entitled:

  • If you have given I@D voluntary consent, to revoke this consent at any time. This will result in I@D no longer processing the data based on this consent in the future (Art. 7 para.3 DSGVO).
  • To receive information about all your data processed by I@D, in particular information about the processing purposes, the category of data, the categories of recipients to whom the user’s data has been or will be disclosed, the planned storage period, the existence of a right to rectification, erasure, restriction of processing or objection, the existence of a right of complaint, the origin of the data if it has not been collected by us, and the existence of automated decision-making including profiling and, if applicable. request meaningful information about its details (Art. 15 DSGVO);
  • In certain cases, you may also ask us to restrict the processing of your personal data, to adapt it, to send it, to transfer the processing to another controller or to stop processing your personal data (Art. 18 DSGVO);
  • To request that your stored data be erased, unless the processing is necessary for the exercise of the right to freedom of expression and information, for compliance with a legal obligation, for reasons of public interest, or for the establishment, exercise or defense of legal claims (Art. 17 DSGVO);
  • To object to the processing of your personal data (Art. 21 DSGVO), if the processing is based on Art. 6 (1) p. 1 lit. e or lit. f DSGVO. This is particularly the case if the processing is not necessary for the performance of a contract with you. Unless it is an objection to direct marketing, when exercising such an objection, we ask you to explain the reasons why we should not process the data as we have done. In the event of a justified objection, we will review the merits of the case and either discontinue or adjust the data processing or demonstrate our compelling legitimate grounds on the basis of which we will continue the processing.

To exercise your rights, it is sufficient to send a letter or e-mail.

9. Security

I@D takes various measures to protect your data from any unlawful appropriation.

However, I@D points out that although I@D takes appropriate technical and organizational measures to ensure protection against unauthorized or unlawful processing of personal data or against loss, damage or accidental deletion of such data, it cannot guarantee absolute security of personal data.

10. Cookies

I@D uses cookies on the website.

Cookies are small, simple text files that your computer or mobile device stores when you use our website. Because we want to guarantee your privacy and improve the user experience of your visit(s) to our website, we think it is important that you know why we use cookies. By setting cookies, you do not have to enter the same information over and over again and can, for example, complete the contact form at a later time. Additionally, they help us understand how you use the website and how we can make the website more user-friendly. Furthermore, cookies (from third-party providers) are set for marketing or analysis purposes and these third-party providers are the parties responsible for processing the data in question.

A distinction is made between session cookies, which are deleted again as soon as you close your browser, and permanent cookies, which are stored beyond the individual session. In terms of their function, cookies are again distinguished between:

  • Technical cookies: these are mandatory in order to navigate the website, use basic functions and ensure the security of the website; they do not collect information about you for marketing purposes, nor do they store which web pages you have visited;
  • Performance cookies: these collect information about how you use our website, which pages you visit and, for example, whether errors occur during website use; they do not collect information that could identify you – all information collected is anonymous and is only used to improve our website and find out what interests our users;
  • Advertising cookies, targeting cookies: these are used to provide the website user with tailored advertising on the website or offers from third parties and to measure the effectiveness of these offers; advertising and targeting cookies are stored for a maximum of 13 months;
  • Sharing cookies: These are used to improve the interactivity of our website with other services (e.g. social networks); Sharing cookies are stored for a maximum of 13 months.

 

11. Use of Google Analytics

This website uses Google Analytics, a web analytics service provided by Google LLC (“Google”). Google Analytics uses “cookies”, which are text files placed on your computer, to help the website analyze how users use the site. The information generated by the cookie about your use of this website is usually transmitted to a Google server in the USA and stored there. In the event that IP anonymization is activated on this website, however, your IP address will be truncated beforehand by Google within member states of the European Union or in other contracting states to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. On behalf of the operator of this website, Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity and providing other services relating to website activity and internet usage to the website operator.

The IP address transmitted by your browser as part of Google Analytics will not be merged with other data from Google.

You may refuse the use of cookies by selecting the appropriate settings on your browser, however please note that if you do this you may not be able to use the full functionality of this website. You can also prevent the collection of data generated by the cookie and related to your use of the website (including your IP address) to Google and the processing of this data by Google by downloading and installing the browser plug-in available at the following link: tools.google.com/dlpage/gaoptout.

This website uses Google Analytics with the extension “_anonymizeIp()”. This means that IP addresses are processed in abbreviated form, thus excluding the possibility of personal references. Insofar as the data collected about you is related to a person, this is therefore immediately excluded and the personal data is thus immediately deleted.

We use Google Analytics to analyze and regularly improve the use of our website. The statistics obtained enable us to improve our offer and make it more interesting for you as a user. For the exceptional cases in which personal data is transferred to the USA, Google has submitted to the EU-US Privacy Shield, www.privacyshield.gov/EU-US-Framework. The legal basis for the use of Google Analytics is Art. 6 para. 1 lit. f) DSGVO.
