I@D Deutschland GmbH, with its registered office at Schleusenstraße 15-17, 60327 Frankfurt am Main, Germany (hereinafter “I@D Deutschland” or “I@D”) processes your personal data when you browse the www.iaddeutschland.de website (the “Website”) and interact with it, in particular when you complete an online form.

Depending on the purposes concerned, this processing may be carried out by I@D Deutschland:

  • As the sole data controller ;
  • As a joint controller with an I@D property consultant.

This Privacy Policy informs you about the collection and processing of your personal data in accordance with Regulation (EU) 2016/679 on the protection of natural persons with regard to the processing of personal data (hereinafter the “General Data Protection Regulation” or “GDPR”) and the applicable German data protection provisions (together the “Applicable Regulations”).

I@D Deutschland also uses cookies and similar technologies as part of the operation of the website. Further information can be found in the Cookie Management Policy.

1. Categories of data concerned

  • Personal Data you send directly to I@D Deutschland

You may need to provide I@D Deutschland and, where appropriate, to I@D property consultants, with personal information in your various interactions with this company, which may identify you directly or indirectly (hereinafter referred to as “Personal Data”).

This mainly includes Personal Data such as:

  • Identification and contact data : first name, last name, title, email address and telephone number;
  • Information about your real estate project.
  • Personal Data that I@D Deutschland collects indirectly

I@D Deutschland collects technical browsing and interaction data on the Website (in particular, through cookies), as well as technical data required for the secure operation of the website, such as the IP address.

2.Purposes, legal basis and retention period

I@D Deutschland collects and processes your Personal Data for the purposes identified in the table set out below, which also explains the legal basis for the processing and the retention period for each purpose.

Your Personal Data may be retained, at the end of the periods identified below, to allow I@D Deutschland to fulfil its statutory or regulatory obligations and assert its rights for any appropriate period with regard to the applicable limitation period. In such cases, the processing operations are performed on the basis of compliance with statutory obligations or the legitimate interests of I@D Deutschland.

I@D Deutschland operates through its network of property consultants, who are independent commercial agents, in the provision of its services. Consequently, you will be put in contact with a property consultant for any request for contact, on any basis whatsoever (to buy or rent a property, do a property valuation or become a property consultant etc.).

This processing is done jointly with an I@D property consultant.

Legitimate interests 3 years from collection or last contact with the data subject.
2. Sending newsletters and other commercial materials, as well as managing the related subscriptions, where you have chosen to subscribe. Consent 3 years from collection or last contact with the data subject.
3. Managing and monitoring your satisfaction with the use of the services(studies, satisfaction surveys and statistics ). Legitimate interests 3 years from collection or last contact with the data subject.
4. Managing and monitoring claims. Legitimate interests 5 years from the end of the litigation
5. Managing your requests to exercise rights. Compliance with statutory obligations Time taken to process the request.

Deletion of the proof of identity document, if requested, as soon as the checks have been completed.

3.Newsletters and Commercial Communications 

Where you have provided your consent, I@D Deutschland may send you newsletters, information about its services and other commercial communications by email.
The personal data collected as part of your newsletter subscription is used exclusively for the management of newsletters and commercial communications and for the administration of your subscriptions.
You may withdraw your consent at any time with future effect by using the unsubscribe link included in each communication or by contacting I@D Deutschland at the following address: privacy@iadgroup.de.
You may unsubscribe from newsletters and commercial communications at any time. 

4.Recipients of your data

The Personal Data collected and processed by I@D Deutschland for the above-mentioned purposes may be communicated, as needed for your file:

  • to the relevant internal departments of I@D Deutschland, in particular customer service, marketing/communications, technical, administrative and legal departments;
  • to its administrative and legal departments if necessary;
  • to its property consultants in the context of responding to requests you have made via online forms on the Website;
  • to I@D Deutschland’s technical service providers, in particular service providers involved in the operation, maintenance, security or transmission of data collected through the website, including onOffice;
  • to the administrative or judicial authorities authorised under French law if necessary.

I@D Deutschland’s business partners and service providers are contractually required to protect the personal data transmitted to them in this context and to use such data only for the intended purposes.

5.Transfers outside the European Union

Your Personal Data may be sent to some of the I@D service providers located outside the European Union.

These transfers are governed by standard contractual clauses or by binding corporate rules (BCR), depending on the provider, and supplemented where necessary by additional measures. You may request additional information and/or a copy of these clauses by emailing I@D Deutschland at privacy@iadgroup.de.

6.Your rights

You may exercise the following rights for your Personal Data, on the terms and within the limits set out in the Applicable Regulations:

  • right of access and information (Art. 15 GDPR): you have the right to be informed about how your Personal Data is processed in a concise, transparent, intelligible and easily accessible form. You also have the right to obtain confirmation as to whether or not your personal data is being processed and, where applicable, access the data by requesting a copy.
  • right to rectification (Art. 16 GDPR): you have the right to have incomplete and/or inaccurate personal data corrected and/or completed.
  • right to withdraw your consent (Art. 7(3) GDPR): when the processing of your Personal Data is based on your consent, you may withdraw your consent at any time.
  • right to object (Art. 21 GDPR): you may object to the processing of your Personal Data for reasons relating to your particular situation.

In some cases, this right cannot be exercised, for example if there are compelling legitimate grounds or for the establishment, exercise or defence of legal claims.

  • right to portability (Art. 20 GDPR): you have the right to receive the personal data you provided to I@D France, to allow you to transfer it to another data controller. This right only applies if the processing of your Personal Data is based on your consent or on the performance of a contract and the processing is performed by automated means.
  • right to restrict the processing of your data (Art. 18 GDPR): in some cases, you may restrict the processing of your Personal Data. This right allows you to temporarily block the use of some of your data, if the statutory requirements are met.
  • right to erasure (Art. 17 GDPR): in some cases, you may request the erasure of your Personal Data (for example, if the Personal Data is too old and is no longer necessary).
  • right to obtain human intervention following profiling or an automated decision (Art. 22 GDPR): when profiling or an automated decision is used, you may request human intervention for the assessment.
  • right to give “post-mortem” instructions: you may decide what is to happen to your Personal Data after your death.
  • Right to lodge a complaint with a supervisory authority (Art. 77 GDPR): You have the right to lodge a complaint with a data protection supervisory authority concerning the processing of your personal data by our company, in particular with the supervisory authority competent for us: The Hessian Commissioner for Data Protection and Freedom of Information, Gustav-Stresemann-Ring 1, 65189 Wiesbaden, e-mail: poststelle@datenschutz.hessen.de.

I@D Deutschland uses appropriate technical and organisational security measures to protect your data against accidental or intentional manipulation, partial or complete loss, destruction or unauthorised access by third parties (e.g. SSL encryption for our website, firewall), taking into account the state of the art, implementation costs and the nature, scope, context and purposes of the processing, as well as the risks of a data breach (including its likelihood and impact) for the data subject. Our security measures are continuously improved in line with technological developments.

However, I@D Deutschland points out that, despite the technical and organisational measures implemented, absolute security of personal data transmitted via the Internet cannot be guaranteed.
